Freehold vs Leasehold

The fundamental difference comes down to ultimate ownership of the land. Dubai's real estate market is split between these two legal frameworks, dictated by zones designated by the Dubai Government.

Absolute ownership

Freehold Property

You get absolute ownership of both the physical building and the land it stands on in perpetuity.

  • Duration: Unlimited. The property belongs to you permanently and passes to your legal heirs.
  • Nationalities: Open to all nationalities, including UAE nationals, GCC nationals and foreign expatriates.
  • Rights: Full authority to sell, lease or renovate (subject to community developer guidelines). You can also obtain long-term residency visas through freehold property investment.
  • Common freehold zones: Downtown Dubai, Dubai Marina, Palm Jumeirah, Dubai Hills Estate, Arabian Ranches and Business Bay.

Time-limited ownership

Leasehold Property

You purchase the right to occupy and use the property for a fixed period, while ultimate ownership of the land remains with the freeholder (often a government master developer or local landlord).

  • Duration: Typically 30 to 99 years.
  • Mechanism: You effectively lease the property from the land owner; when the lease expires, ownership reverts to the land owner unless officially renewed.
  • Nationalities: Historically used to allow foreign investors access to areas outside designated freehold zones, though any nationality can enter a leasehold agreement.
  • Rights: You can rent out or sell the remaining years of your lease. Major structural modifications require written permission from the land owner.
  • Common leasehold zones: Specific older sections of Deira, Bur Dubai, Jumeirah and certain plots within older master developments such as Al Karama.
